        Undoubtedly, political thoughts bears frameworks and basis without which one can`t recognize correct knowledge of them. In this regard, Imam Khomeini`s thoughts are not exception. Thus researcher in this paper attempts to investigate its effects on Imam Khomeini’s political thought which are manifested in Velayat Faqih thought. As a thesis it seems that Imam Khomeini, based on Spiritual-Gnostic insight inspired from Mollasadra thoughts, considers politics beneath the religious principles and he attempts to define piety and it`s requirements that which covers politics as a part of his duties. Practical result of such combination is devoting practical politics field and statesmanship to Juris consults and theologians as Velayat Faghih form. In his insight, Islamic governor shall obey justice as much as possible since it`s requirement for governance and guardianship and despotism makes us fall from it. Thus focusing on governor’s responsibility before public, he denies dictatorship and autocracy. In this research, we utilized note taking and library study to gather data and epistemological methodology and thought interpretation based on rational structures and requirements as a part of intellectual approach as a research method. The concepts and elements have been formed before revolution and as a result of revolution on one hand, and the intellectual attempts of compilers regarding conventionalizing issue. The great characters of revolution not only did not have any perception and special thought of law in their minds, but also they did not think well about the process of law formulation. So while formulating the constitution, they are faced with various difficulties for formulating the key clauses such as sovereignty problems and peolple’s rights and principal freedoms. So for understanding the philosophy and the process of constitution phenomenon in Islamic Republic of Iran, the historical concepts and its formation process and also conventionalizing process of laws should be considered.         One of the most controversial issues about the political thought of the founder of the Islamic Republic is the difference between his political thought in the 20s and 30s with 40s AH onwards. Especially in the two books of "Kashf e Asrar", that he believes in a kind of supervision of the Faqih over the political structure and in the book "Velayat-e-Faqih", that he proves the necessity of an Islamic government led by a Fqih. Based on this, an important question arises. Should we not follow the idea of the Islamic government in the book " Kashf e Asrar " in the sense explained in the book "Velayat-e-Faqih"? Many researchers have answered this question in the affirmative from different perspectives. But the findings of the present study, which are mainly based on the study of theoretical and historical contexts, show that, in fact, it has not occurred a fundamental change in the political thought of Ayatollah Khomeini and the idea of Islamic government, which is explained in the book "Velayat-e-Faqih", can also be found in the book " Kashf e Asrar ", of course not explicitly. Therefor authority or guardianship of anyone else is illicit, unless the one that is permitted by Him. Having authority over others without His permission is regarded to be unacceptable, false, oppression and transgressing other people’s rights. This guardianship of Allah SWT is manifested as a divine Grace by sending of the prophets and is maintained by the infallible Imams. Since divine Grace is one of the attributes of Allah SWT and His attributes are not subject to alteration, this wise Grace is to be constant at the time of occultation as well. Here the necessity of the guardianship of the jurists as the closest people to the attributes of the infallible Imams and the most trustworthy one’s to handle the tempting position of leadership, in order to protect and continue the course of Imamate and guidance, is comprehended.         The subject of public welfare and public works are important issues among Muslim philosophers such as Shi'a and Sunni. On the one hand, this issue, similar to some other issues in governmental jurisprudence, has partly been influenced by verbal differences between Sunnis and Shi'as. Accordingly, the Sunni people had paid more attention to the public aspect of public affairs due to the acceptance of caliphate sovereignty, but Shiite jurisprudents had often considered most non-governmental aspects of public affairs. The proper unity and appropriate consensus between the jurists (in their foundations and approaches to the public welfare and public works) in the expansion and limitation of the extent of the implementation of these divine commandments are not observed (although there is a consensus in the sense of affairs). This discrepancy indicates that each of them has different foundations and approaches compared to public welfare. According to the above descriptions, there are two theories and views on the excerpts of the public works. The first view is that the domain of this institution is limited to the guardianship of the estate of the orphans, insane people, and bankrupt orphans. The second view does not limit the scope of public works to specific issues and has a wider perspective than the first view, which also includes social, economic, political, and cultural issues. Even though the public works are one of the vague issues in legal affairs, legislators have not considered a comprehensive definition of it and have not provided an effective criterion for identifying it. Therefore, the main objective of this research is the comparative study of public works for the jurisprudence of Shia and Sunni jurisprudence' views by the codified statue. Also, the findings of this research show that the scope of public works in the Sunni jurisprudence is limited to the issue of Enjoining good and forbidding wrong, but for the Shiite jurisprudents, it covers everything that leads to the disorder in a social system and the fault in society.         Velayat, meaning the rule of the jurisprudent, is considered in jurisprudence and in theology in a narrative and rational way. The main issue of the present article is the Qur'anic citations of the rational reasons for the legitimacy of Velayat-e-Faqih by examining the application of "wisdom" and its application to the issue of Velayat. In the Qur'an, companion book and wisdom means the Qur'an and the guardianship of Ali ibn Abi Talib (as). This wisdom is received by the prophets through revelation and the ummah of the Prophet of Islam (peace and blessings of Allaah be upon him) through reason and narration. Therefore, the authority of reason for the legitimacy of the province continues after the infallible. On the other hand, wisdom meaning guardianship cannot be any kind of wisdom and guardianship due to its association with the book meaning the Qur'an.         Protecting children at risk is one of the most important issues of child rights under international and regional conventions and domestic laws. The principle accepted in family law is the parent's priority for child custody. However, if the child’s welfare requires, one way of protecting children with unqualified parent(s) is to keep them in a safe environment outside the family by qualified persons or public or private entities and institutions. In this way, the ultimate goal is to restore parental ability, rebuild family relationships and provide the opportunity for the child to return to the family. This study uses library resources, laws, regulations and interviews with experts and professionals of Behzisti (State welfare organization) and judiciary to try to identify different ways of providing administrative and judicial support to orphaned or abandoned children In order to provide effective guardianship and care for them. According to current laws and regulations, in case of guardianless or neglected child, caring for him/her would be in a family setting and otherwise in a residential child care community. In addition to restoring family competence, the independence of the supported child also terminates the intervention of public institutions to support children and adolescents without effective guardian.         The Iranian people, led by Imam Khomeini revolted for the establishment of Islamic rule. Today the world's ‎dominant discourse is democracy and for this purpose, the nature of the government of Iran became Islamic Republic that ‎democracy is form and Islamic is terms of content of government. Due to the lack of experience of Islamic countries in ‎democratic, western systems of governance was accepted to implement democracy. For Islamization of the government, it ‎placed the Supreme Leader at the head and the Guardian Council supervisory of parliament. Now, after nearly four decades ‎is essential to be revised in the governance structures. If there is a fault in the system should be desgined a system based on ‎religious approch and according to the conditions implement that in the absence of Imam Islamic roles should be ‎implemented. ‎ The study based on religious principles, characteristics of Islamic government and conditions of our country a ‎model for implementing religious government is designed. Content analysis method is used to obtain principle that should ‎be considered in the design of governance structures. For finding religious (Islamic) government a questionnaire among 30 ‎people who were selected snowball was distributed and analyesd with AHP method.         Political lifestyle refers to the particular method of encountering the most important duties of the realm of political life that develops in order to achieve political purposes. Given the important role of ontological principles in constructive approaches to lifestyle, their analysis in the political lifestyle of Imām Khomeinī, as an individual with his own style, seems necessary. Accordingly, this paper is intended to investigate the effects of the principles of the Transcendent Philosophy in relation to the principiality of existence, goodness of existence, unity of being and plurality in its manifestation, simplicity of existence, and the place of perfect Man in the levels of being based on Imām Khomeinī’s political lifestyle. An analytic library study of the publications on Imām Khomeinī’s life and character indicates that commitment to the principles of Sadrian philosophy played a significant role in the development and consolidation of his political lifestyle. Moreover, given the gradation at three levels of the “political lifestyle of the perfect Man”, “the political lifestyle of the divine leaders influenced by the perfect Man”, “the lifestyle of people who follow the political life of divine leaders”, Imām Khomeinī, as a figure believing in the truth of the perfect Man, managed to have the support and trust of a huge number of people through insisting on providing for the conditions required for people’s access to the perfect Man’s lifestyle in order to attain a new style of transcendent political life. of the Islamic Republic of Iran institutionalized the principle of Guardianship of the Jurist (Velayat-e Faqih) in the country and extended its influence over all aspects of the lives of the Iranian people. Ayatollah Hussein-Ali Montazeri and Ayatollah Seyyed Mohammad Hosseini Beheshti played an irreplaceable role in formulating the Constitution due to their positions in the parliament. Each of these two eminent figures had significant differences in their understanding of the Constitution and its concepts. This article, from the perspective of Skinner's hermeneutic method, delves into analyzing the prominent roles of these two figures in the Islamic Revolution in the drafting of the Constitution. What were their intentions and practical actions within the political system established by the Constitution? During a time when Islam was severely threatened by Western thought, they aimed to establish an Islamic political system. Montazeri believed that the principles and rules of fiqh concerning the concept of Guardianship of the Jurist were sufficient for governing Islamic society, while Beheshti viewed Islamic principles and standards around the axis of Guardianship of the Jurist as a framework that could selectively incorporate modern democratic, Marxist, and human rights concepts to be responsive to the current Iranian Islamic society.         <p>With the emigration of Imam Reza (a.s.), places of pilgrimage and worship were established in Iran, which can be referred to as the construction of buildings such as mosques and seminaries centered on Shiite culture. The migration of Sadat after the arrival of Imam Reza (a.s.) to Iran, which was later persecuted by the Abbasids and many of them were martyred in different cities, and the tombs of each became a focus for Shiite culture and spread Shiism. The blessed tombs in Iran is a manifestation of the ideals of Shiism that was rooted in Islam and in fact it is considered a huge support for the high standards and values of the Shiite school. The main question of this research is what effect did the presence of Imam Reza in Iran have on the moral behavior of the people? The method of this research is descriptive-analytical. The results of this research show that with the presence of Imam Reza (a.s.) in Iran, people were guided towards spirituality, and after his martyrdom, the people of Iran were invited by promoting the culture of pilgrimage and the presence of Sadat. They found an increasing growth in spirituality.
