ملخص المقالة :
مقاله حاضر به بررسی چالشهای همگرایی و واگرایی در حقوق خصوصی جهانی، با تمرکز بر حوزههای قراردادها و مسئولیت مدنی میپردازد. در عصر جهانیسازی، افزایش تعاملات فرامرزی و تجارت بینالمللی، تفاوتهای نظامهای حقوقی، فرهنگی و اقتصادی را به چالشهایی عمده در مسیر همگرایی حقوقی تبدیل کرده است. با استفاده از روشهای تطبیقی و تحلیل کیفی، تفاوتهای نظامهای حقوقی «کامنلا» و «حقوق نوشته» در حوزههای قراردادها و مسئولیت مدنی بررسی شده و راهکارهایی برای تقریب این نظامها ارائه میشود. همچنین، نقش سازمانهای بینالمللی مانند UNIDROIT و CISG در همگرایی حقوقی تحلیل شده است. در پایان، پیشنهاداتی برای تحقیقات آینده در زمینه تأثیر فناوریهای جدید و نقش حقوق اسلامی و سایر نظامهای حقوقی غیرغربی در همگرایی حقوقی ارائه شده است
