چکیده مقاله :
در طول تاریخ، جدای از مسائل و نهضت های سیاسی و دینی و گرایشات و تمایلات مختلفی که در جوامع در حال تغییر و پیشرفت و گاهی نیز رو به سوی فرو پاشی بوده است، خانواده به عنوان اصلی ترین نهاد هر جامعه، تحت تاثیر عوامل مختلف دچار تحولات گوناگونی شده و همواره در معرض خطرات مختلفی من جمله فروپاشی و کاهش گرایشات اخلاقی قرار گرفته است، بر همین اساس حقوقدانان، فقها و معلمان اخلاق، برای جلوگیری از پاشیدگی این نهاد اصلی جامعه و به منظور مصونیت خانواده از تحولات منفی جوامع، دست به وضع یک سری حقوق و تکالیف در خانواده زده اند. چه اینکه در بین علوم مختلفی که به بررسی خانواده و نقش آن در تربیت فرزندان می پردازد علم اخلاق دارای مسولیت خطیرتری است، و چه بسا تمام علوم مرتبط با خانواده من جمله حقوق و علوم اجتماعی و روانشناسی بر پایه اخلاق پایه گذاری شده اند، و علم اخلاق خود برگرفته از تعالیم اسلامی و آیات وارده می باشد و با توجه به اینکه در اموزه های دینی شریعت اسلام آنچه بیش از همه مورد توجه بوده، حفظ و نگهداری کانون خانواده به عنوان امن ترین رکن جامعه، است، چه بسا می توان گفت که علم اخلاق، اساس و پایه نگارش حقوق خانواده می باشد.
