Feasibility of Criminalizing Technology of Digital Crypto Currencies In The System Of Goverming The Smuggling Of Goods And Curreccies

Abstract :
The development of information technology in today's era has led to the invention of technological tools, the use of which in the exchange system has sometimes created challenges. One of the technological tools created prior to the creation and development of information encryption technology and distributed platforms are digital cryptocurrencies. These exchange tools fall into two general categories derived from decentralized platforms or produced by government authorities. The main question of the present research is, what effect has the use of these technological tools had on the system governing the smuggling of goods and currency in Iran, and will the titles of goods smuggling or currency smuggling be compatible with them? To answer this question, the present qualitative research proves by documentary method that the type of cryptocurrency produced by the governments of countries, according to the monetary and banking laws approved in 1351 and the fight against smuggling of goods and currency approved in 1394 of Iran, is considered currency and should be used in The inclusion of regulations governing currency has been interpreted, but the possibility of presenting conflicting interpretations of the type derived from decentralized platforms can make researchers elaborate on the application of goods or currency smuggling regarding these types of instruments. Based on this, in the conclusion section, the present article has attempted to provide some policy-making recommendations in order to reform the legislative system in the field of digital cryptocurrencies in Iran.
