Abstract :
Given the fact that the waters are part of the mobayat, and the mobaids are captured through the abyss, the question arises as to whether public waters are owned by persons؟ According to the water law and its nationalization status in 1347, waters of the Mobah are considered as one of the public assets administered by the government. According to some lawyers, by the adoption of the National Water Act of 27/4/1347, Article 149 has been abolished, the civil law has become obsolete and the issue of water ownership has been abolished. The public domain of national wealth is considered a country and belongs to all generations. The economic value of these assets is primarily due to the special protection and maintenance of these properties. To prevent private individuals from handing over public property and preventing government and public deprivation in relation to these assets, there are several solutions, such as the use of new technologies, strengthening of regulatory bodies, and so on. . But the most important ways in this regard is to provide legal solutions as a way to solve the root causes of problems. In this research jurisprudential and legal perspectives in this field will be investigated and some solutions will be presented in order to solve public water problems.
